1. Purpose of the Website

KasselDesign.com provides general information about Kassel Design, our capabilities, portfolio, creative work, business growth services, branding services, website services, digital marketing services, hosting, website management, consulting, and related professional services.

Website content is provided for general informational and promotional purposes. Information appearing on the website does not constitute a binding offer, guarantee, or contractual commitment unless expressly stated in a separate written agreement signed or electronically accepted by Kassel Design and the client.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to use this website or request services.

If you use the website on behalf of a business, organization, or other legal entity, you represent that you have authority to act on behalf of and bind that entity.

3. Website Use

You may use this website only for lawful purposes and in accordance with these Terms.

You agree not to:

  • Use the website in violation of any applicable law or regulation.
  • Attempt to gain unauthorized access to the website, server, hosting account, database, forms, or connected systems.
  • Introduce viruses, malware, malicious code, automated attacks, or other harmful technology.
  • Interfere with the website’s security, availability, performance, or functionality.
  • Scrape, copy, harvest, index, download, or reproduce website content through automated means without written permission.
  • Impersonate Kassel Design, an employee, a client, another visitor, or any other person or entity.
  • Submit false, misleading, fraudulent, defamatory, unlawful, or infringing information.
  • Use website content, project examples, designs, strategies, written materials, or intellectual property to create competing services, train artificial intelligence systems, or develop commercial products without written permission.
  • Use the website to send spam, unsolicited promotions, or abusive communications.

We may restrict or terminate access to the website when we reasonably believe a visitor has violated these Terms or created a security, legal, or operational risk.

4. Service Inquiries and Consultations

Submitting a contact form, questionnaire, business growth audit, discovery call request, quote request, or other inquiry does not create a client relationship or require Kassel Design to accept a project.

We reserve the right to decline any inquiry or proposed engagement at our discretion.

Any preliminary comments, recommendations, ideas, timelines, budgets, estimates, or strategies provided during an inquiry or consultation are for discussion purposes and may change after we review the complete project requirements.

A client relationship begins only when the applicable proposal, service agreement, statement of work, invoice, subscription agreement, or other written agreement has been accepted and any required initial payment has been received.

5. Client Agreements

Paid projects and ongoing services may be governed by separate documents, including: Proposals, Statements of work, Service agreements, Hosting or website management agreements, Subscription agreements, Estimates, Invoices, Change orders, Project schedules, Platform-specific terms, and Written amendments.

If a separate client agreement conflicts with these website Terms, the separate client agreement will control with respect to the services covered by that agreement.

These website Terms are not intended to replace a project-specific service agreement.

6. Estimates, Pricing, and Availability

Prices, packages, descriptions, timelines, examples, and availability shown on the website are subject to change without notice.

Unless expressly identified as a fixed-price offer, pricing discussed through the website or during an initial consultation is an estimate and may change based on project scope, revisions, functionality, content requirements, licensing, integrations, third-party expenses, rush requests, client delays, or other project considerations.

Taxes, software subscriptions, hosting charges, domain fees, stock assets, premium plugins, advertising expenses, printing, photography, video production, outside contractors, and third-party services may be billed separately unless expressly included in a written proposal.

7. Payments, Deposits, and Refunds

Payment requirements for Kassel Design services will be stated in the applicable proposal, agreement, invoice, or subscription terms.

Unless otherwise agreed in writing:

  • Deposits and initial project payments reserve production time and may be nonrefundable once work has begun.
  • Completed work, labor, consultations, strategy, research, subscriptions, hosting, domain services, third-party purchases, and digital services are generally nonrefundable.
  • Final deliverables may be withheld until all outstanding balances have been paid.
  • Late payments may result in paused services, delayed launches, loss of reserved production time, or suspension of hosting, maintenance, marketing, or related services.
  • Additional work outside the approved scope may require a change order or additional invoice.

Specific payment, cancellation, refund, and termination terms in a signed proposal or service agreement will control.

8. Client Responsibilities

Clients are responsible for providing complete, accurate, lawful, and timely information needed to perform the requested services.
